WELCOME TO THE SCARBOROUGH PLANNING & CODES DEPARTMENT

The responsibilities of the Planning and Codes Department include code enforcement, development review, development and building inspection, community and transportation planning, engineering and land use regulation. There are a range of state and local building, land use and environmental regulations designed to protect the health, safety and welfare of town residents and visitors as well as to ensure that Scarborough continues to develop in an attractive, orderly manner. One of the primary duties of our Department is to interpret, enforce, and assist the public with these regulations. In addition, we work on both short and long-range planning initiatives as well as make recommendations on updates and amendments to the town’s local land use and environmental regulations. The staff in Planning and Codes is here to assist town residents, businesses, and property owners as well as to advise the Town Council, Planning Board, Zoning Board, and other town committees and departments.

INTRODUCTION TO PLANNING

Scarborough is one of the fastest growing and dynamic communities in southern Maine. Given this, the review of new development and redevelopment as well as short and long-range planning initiatives are critical to managing our community. One of the primary duties of Planning Staff is to advise the Planning Board in the review and approval of new development or redevelopment projects as well as to work with development applicants through the review process. The vast majority of development projects are reviewed under the Site Plan Review or Subdivision Review Ordinances. As for short and long-range planning, the Town’s Comprehensive Plan is the guiding document for how Scarborough should grow and develop over the next ten years and beyond. Planning Staff play an important role in working with the Town Council and other committees on updating as well as implementing the Comprehensive Plan. Very often the implementation of the Comprehensive Plan requires changes to the town’s local land use regulations. In addition, Planning Staff conduct other short and long-range planning studies and initiatives that may pertain to other topics such as transportation, open space and natural resource conservation, affordable housing, and infrastructure planning.

INTRODUCTION TO CODE ENFORCEMENT

The Code Enforcement Officers are responsible for interpreting and enforcing the local, state, and in some cases, federal regulations that apply to building construction and development as well as inspecting the wide range of new development and redevelopment that is occurring in Scarborough. Code Enforcement processes and approves the required permits for the construction of new structures and electrical, plumbing and heating work as well as signage and various other site amenities. We do this through the administration of a range of regulations including the Zoning Ordinance, Shoreland Zoning Ordinance, building and plumbing codes, Growth Management Ordinance, and others. Once the requisite permits are issued and construction or installation begins, the Code Enforcement Officers are responsible for the inspection of the residential or commercial construction or installation that is occurring. Inspections range from projects as complex as new medical buildings and large commercial structures to ensuring residential decks are properly installed or garden sheds meet the required setbacks. In addition to their code and inspection duties, Code Enforcement also acts as staff to the Zoning Board of Appeals in their appeals, variance and special exception processes.
